1. BOOKING FEE + PAYMENT: The Client shall make full non-refundable payment to retain the Photographer to perform the services selected at checkout. The preferred method of payment is via Stripe.
2. SERVICES: The Photographer shall provide only the services paid for by the Client. Any extra services, will incur additional charges.
3. PRODUCTS: The Photographer shall provide only the products paid for by the Client. Galleries for sessions will be delivered through the online message or email provided by the Client at the time of booking within thirty (30) days after client finalizes their selections. Final images selections must be made with one (1) week of gallery delivery. Online gallery will be available for thirty (30) days after gallery is finalized with clients chosen images. Number of images delivered per session depends on the session or package selected by the client.
4. LOCATION AND SESSION TIME: The Photography Session will take place at the location and time specified in the clients selection. Studio sessions will take place at my studio located in Yorktown. Client agrees that if he or she is late to a session, such time will be deducted from the time allotted for the Photography Session.
5. CANCELLATION: If the Client cancels services, the Client agrees to forfeit the payment previously made at the time of booking. No refund will be provided.
6. RESCHEDULING: For mini sessions, rescheduling may not be available and may incur additional fees. Contact photographer.
7. RELEASE FROM LIABILITY: Client and minor children of the Client are not obligated to perform any act the Client deems dangerous or otherwise inappropriate. The Client agrees to let the Photographer know if the Client does not wish the Client or the Client’s minor children to perform or participate in any act, including, but not limited to: the use of props or positioning in certain poses requested by the Photographer. While all reasonable precautions will be made to ensure the safety of any photography model, Client acknowledges that accidents may occur. Client hereby agrees to indemnify and hold harmless the Photographer (including Photographer’s employees, agents, or business associates), from any injuries, damages, or other losses that may occur directly or indirectly as a result of the photography session.
8. COOPERATION: The cooperation of a clients or subjects during a photo session is extremely important to the end results. The Photographer is not responsible for uncooperative or disruptive behavior. The Photographer will work, to the best of her abilities, to redirect uncooperative or disruptive behavior, but retains the right to end the session even if the time frame has not been met if the subjects continue to be uncooperative or disruptive. Client understands it is their responsibility to manage the behavior of the subjects in the photo session and will not hold Photographer liable for shots or missed poses due to a session ending early. Uncooperative or disruptive clients does not constitute a reason for a reshoot. Reshoots due to a lack of cooperation will only be scheduled at the Photographer’s discretion and may require additional fees.
9. GARMENTS/PROPS: The Photographer cannot be held responsible for the damage to garments or props provided by the Client during a session.
10. ARTISTIC STYLE: The Client acknowledges that Lindsey Reid Photography requires and retains discretion as to how its services shall be provided (e.g. choice of poses, lighting, lenses, etc.); that Client(s) are familiar with the Photographer’s portfolio and is requesting Services with knowledge of the Photographer’s style; that Photographer’s work is constantly evolving; that Photographer’s services are of unique and artistic nature; that the images created may be different from images taken by the Photographer in the past; and that in creating the images, the Photographer shall use her personal artistic judgment to create images consistent with her personal vision of the session, which vision may be different from the Client and /or the Subject’s vision of the session. Accordingly, the Client acknowledge that the images shall not be subject to rejection on the basis of taste, esthetic criteria, or personal appearance.
11. EDITING: The Photographer will only deliver edited images that meet her high standards of quality. The Photographer retains complete control over the culling and editing process. Minor edits and touchups will be accomplished as a part of the Photographer’s standard editing process. More extensive retouches available but may be subject to an additional fee.
12. COPYRIGHT: The Photographer retains the exclusive copyright protection for all images taken during the Photography Session. The Client may not, without the express written permission of the Photographer, use the images taken during the Photography Session for professional display, profit, or other commercial endeavors. All images displayed on Photographer’s websites are subject to the protections of this paragraph. For all purchased images, the Photographer grants the Client permission to share the purchased images with family, friends, and on social networking websites so long as the images remain unaltered and textual credit as provided by the Photographer.
13. CLIENT USAGE: The Client has the permission of the Photographer to obtain prints for personal use only, and shall not sell said prints. If Client is obtaining a print for newspaper announcement of the event or session, editorial use or website, Photographer authorizes Client to reproduce the print in this manner. In such event, Client shall run a credit for the Photographer, including Photographer’s website, adjacent to the photograph. Images shall not be retouched or edited in any manner by the Client or by Family and Friends of the Client. If further editing is requested, the Photographer shall offer a quote for retouching services.
14. FAILURE TO PERFORM: If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the Photographer’s illness, then the Photographer shall return full payment to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.
15. PHOTOGRAPHER’S STANDARD PRICE LIST: The charges in this Agreement are based on the Photographer’s Standard Price List. This price list can be found on the Photographer’s website under the Investment page and is adjusted periodically. Future orders shall be charged at the prices in effect at the time when the order is placed.
16. REFUNDS: Refunds will only be granted at the Photographer’s discretion. Mini sessions are not eligiable for refunds. No refunds will be given once the client has downloaded images via the online gallery. By downloading the images, the Client accepts these images as the final product and waives all right to a refund by taking possession of images.
17. MODEL RELEASE: The Client(s) hereby grants to Lindsey Reid Photography and successors, heirs, executors, administrators, assigns, attorneys, representatives and agents, the irrevocable and unrestricted right to use and publish photographs of the Clients or in which the Clients may be included, for editorial, trade, advertising or any other purpose and in any manner or medium; to alter the same without restriction; and to copyright the same. The Clients hereby release Lindsey Reid Photography and all associates representatives and assigns from any and all claims, actions, demands, suits, liabilities, damages, expenses, and obligations of any kind arising from, or related in any manner to Lindsey Reid Photography use of said images. I hereby give to Lindsey Reid Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child. This include the ability to use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, studio display, gallery display, websites, social media and;
I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.
